Terms of Use
Effective date: 15 September 2026
These Terms of Use ("Terms") govern your access to and use of the Pesticide Stock Management System ("PSMS" or the "Platform"), including the website at psms.bcrc-caribbean.org, its application programming interface (API), and the PSMS mobile application. The Platform is operated by the Basel Convention Regional Centre for the Caribbean ("BCRC-Caribbean", "we", "us").
By creating an account, signing in, or otherwise using the Platform, you agree to these Terms and to our Privacy Policy. If you use the Platform on behalf of a government agency, company or other organization, you confirm that you are authorized to accept these Terms on its behalf.
1. What the Platform is
PSMS is a regulatory information system used by national pesticide regulatory authorities ("Regulators") and by the businesses and individuals they regulate — such as importers, distributors, sellers and facility operators ("Regulated Parties"). It supports product registration, organization licensing, import permits, shipment recording, stock management, facility inspections, sales reporting, and disposal and waste management.
Each Regulator operates its own separate workspace (a "tenant") on the Platform. Data entered into a workspace belongs to, and is administered by, that Regulator.
2. Accounts
- Eligibility. Accounts are for people acting in a professional capacity for a Regulator or a Regulated Party. The Platform is not intended for personal or consumer use, or for anyone under 18.
- Account approval. An account may be created by an administrator of your workspace, or requested through self-registration. A Regulator may approve, limit, suspend or close any account in its workspace.
- Accurate information. You must provide accurate, current information about yourself and the organization you represent, and keep it up to date.
- One person per account. Accounts are personal. Do not share your password, two-factor authentication codes, recovery codes or access tokens with anyone.
- Security. You are responsible for activity carried out under your account. Tell your workspace administrator, or contact us, immediately if you suspect your account has been compromised.
3. Acceptable use
You agree not to:
- submit information you know or suspect to be false, incomplete or misleading;
- access, or attempt to access, data belonging to another organization or workspace that you have not been authorized to see;
- probe, scan or test the vulnerability of the Platform, or bypass any authentication, rate limit or access control, except as part of a security assessment we have authorized in writing;
- interfere with the operation of the Platform, including by overloading it with automated requests;
- upload malware, or content that is unlawful, infringing or unrelated to the purpose of the Platform;
- copy, resell or commercially exploit the Platform or its data other than for the regulatory purposes it serves;
- reverse engineer the Platform, except to the extent applicable law expressly permits it.
4. Regulatory submissions
Information you submit through the Platform — for example registration applications, permit applications, shipment details, stock levels, sales reports, disposal records and inspection findings — may be relied on by a Regulator in carrying out its legal functions.
- You are responsible for what you submit. Submitting information through the Platform does not reduce any obligation you have under the pesticide laws and regulations that apply to you, and false or late submissions may have consequences under those laws.
- Decisions are the Regulator's. Approvals, clearances, licenses, permits and other regulatory decisions are made by the relevant Regulator, not by BCRC-Caribbean. The Platform records those decisions; it does not make them.
- Records are retained. To keep an accurate regulatory record, changes to data are logged, and some records cannot be edited or deleted once they reach certain stages.
5. Integrations, API keys and the mobile app
- Workspace administrators may issue API keys and configure integrations, webhooks and data imports. Whoever holds an API key can act within the permissions granted to it, so keys must be kept secret and revoked when no longer needed.
- Data you send to an external system through an integration is governed by that system's own terms. We are not responsible for third-party services.
- The mobile application may store inspection data on your device so that it can work offline until it is synchronized. You are responsible for the security of the devices you use to access the Platform.
6. Your content
As between you and us, the data you and your organization enter into the Platform remains yours or your Regulator's, as applicable. You grant BCRC-Caribbean and the Regulator for your workspace the rights needed to host, process, back up, display and transmit that data in order to operate the Platform and support the Regulator's functions, as described in the Privacy Policy.
You confirm that you have the right to submit the content you upload, including documents and photographs.
7. Our intellectual property
The Platform — its software, design, text, documentation and user manual — is owned by BCRC-Caribbean or its licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Platform for its intended purpose while your account is active. No other rights are granted.
8. Availability and changes to the Platform
We aim to keep the Platform available and secure, but we do not guarantee uninterrupted or error-free operation. We may carry out maintenance, during which access may be restricted, and we may change, add or remove features. We will try to give reasonable notice of changes that significantly affect how you use the Platform.
9. Suspension and termination
We, or the Regulator for your workspace, may suspend or close your account if you breach these Terms, if your account appears to be compromised, if your role or organization no longer requires access, or if required by law. You may stop using the Platform at any time and ask your workspace administrator to close your account.
When an account is closed, regulatory records you created are generally kept, as described in the Privacy Policy, because Regulators may be required to retain them.
10. Disclaimers
The Platform is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Reports, dashboards, expiry alerts and notifications are aids to regulatory work. They depend on the data entered and on correct configuration, and they do not replace your own obligation to comply with the law. Do not rely on the Platform as your sole reminder of a legal deadline.
11. Limitation of liability
To the fullest extent permitted by law, BCRC-Caribbean will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, revenue, profits or business opportunity, arising from or related to your use of, or inability to use, the Platform.
Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Changes to these Terms
We may update these Terms from time to time. The effective date at the top of this page shows when they last changed. If a change is significant, we will take reasonable steps to let users know, for example by a notice in the Platform. Continuing to use the Platform after a change takes effect means you accept the updated Terms.
